FeganScott filed a class action lawsuit against CDK Global as part of a team of affiliated law firms, claiming the dealership software solutions company failed to maintain data security measures, resulting in two data breaches impacting more than 15,000 auto dealers, repair shops, and other businesses.
The lawsuit alleges that between June 18 and 19, 2022, CDK Global experienced two cyberattacks that caused weeks-long software outages. These outages prevented customers from processing sales and delayed service requests and parts orders. According to the complaint, the incidents cost CDK Global customers hundreds of millions of dollars in lost business.
The complaint details the experiences of four businesses following the data breaches: an independent Ford dealership in Hamburg, Pennsylvania; an automobile broker in Agoura Hills, California, and two repair shops in Ada, Oklahoma.
The four businesses claim that CDK Global neglected to provide adequate data security, which resulted in the cyberattacks. They also claim that following the attacks, the company ceased access to its services, leaving thousands of customers unable to operate effectively despite continuing to charge them for those services.
The lawsuit seeks to recover damages for the plaintiffs’ monetary losses during the software outages.
