In November 2024, FeganScott filed a class action lawsuit alleging that, since at least January 2021, the top potato processors in the United States operated an unlawful anticompetitive scheme that allowed them to drive up the price of frozen potato products.

What happened?

According to the complaint, a group of major U.S. potato processors used PotatoTrac, an industry data aggregator, to exchange sensitive information and use it to raise, fix, maintain, stabilize and coordinate the price of their frozen potato products, a market they control 98 percent of. The complaint alleges that the companies’ scheme wholly suppressed competition, forcing consumers to pay illegally inflated prices for frozen potato products.

Which companies are named in the lawsuit?

Our class action lawsuit alleges that the yearslong price-fixing scheme was operated by the National Potato Promotion Board (NPPB) and four of its member companies, including Lamb Weston, McCain Foods, J.R. Simplot Co., and Cavendish Farms. The company that owns and operates PotatoTrac, Circana, is also named in the suit.
