This week, Fegan Scott LLC filed an amicus curiae brief on behalf of the National Consumers League, Consumer Federation of California, and Center for Auto Safety in the Ninth Circuit Court of Appeals. Our brief urges the Court to recognize the real-world consequences of allowing auto manufacturers to escape liability for deceptive acts under the Racketeer Influenced and Corrupt Organizations Act (RICO) merely because consumers purchase their cars from dealers, rather than directly from manufacturers. RICO was designed to reach systemic fraud, and carving out special protection for powerful industries that sell through dealers would leave consumers without recourse, embolden misconduct, and shift the costs of corporate fraud onto the public. Allowing victims to seek justice under RICO promotes accountability, deters racketeering activity, and safeguards trust in our courts and markets.
