SAN FRANCISCO – On March 5th, the Court denied certification of a class of former baseball players bringing claims against the University of San Francisco (USF) and two former USF coaches, Nino Giarratano and Troy Nakamura. The decision does not impact the individual claims of the thirteen Named Plaintiffs, whose fight against USF and the coaches continues. The decision may also open a window of time for other players to file individual lawsuits.
While the Court’s decision to deny class certification is disappointing, “the decision was merely procedural and reflects the Court’s desire to allow each student-athlete his own trial,” Beth Fegan said in a statement to the San Francisco Chronicle.
